I think personally that they shouldn't be included in the draft. Expansion GM's should be allowed to discuss signing a free agent, but shouldn't have the right to select them? They're not on a team currently. They're a free agent. They should have the same abilties to sign with an expansion team as they could with a regular team.

They would give themselves exclusive negotiation rights to the free agent player for that period of time before free agency. If it's worth it for the GM, then great, and if not, no problem. If the free agent player is intent on hitting free agency it doesn't hurt them either. I don't see it being negative for anyone.
