kckolbe appeal decision - bovovovo - 12-13-2018

Hello NSFL,

As many of us know, @kckolbe appealed his recent punishment for leaking (found HERE). The process for appeals (since this is the first one) is that the appeals committee will confer and offer recommendations to HO on whether the original punishment was justified, should be reduced, or even possibly completely removed. HO then considers the commitee’s recomendation and decides what to do next.

In this case, after considering the points brought forward by the appeals committee, HO has decided to reduce kckolbe’s punishment.

The primary/general reason why is because 1. We consider what kckolbe did as leaking draft information. He knew the results and provided advice, that’s considered a leak and there is precedence to that. HOWEVER 2. This expanded definition of what a “leak” is was not written down in the rulebook, even though precedence is there.

Because of this gray area we are reducing the punishment.

The original punishment was:
- $8,000,000 fine
- Loses out on mock draft tpe for this season (S12 Mock Draft) and next season (S13 Mock Draft)
- Not allowed to be in a draft war room for the remainder of this season (S12 up to the S13 draft) and next season (S13 up to the S14 draft)

The reduced punishment:
- $8,000,000 fine
- Loses our on mock draft tpe for only this season
- Not allowed to be in a draft war room for only the next draft (S13)

We would also like to take this opportunity to set in stone clear expectations and rules regarding non-GM war room participation, which will be added to the rulebook.

The TLDR of the below is that we’re holding non-GM war room members to the same standards as GMs as far as leaking is concerned.

1. All non-GM war room members must be reported to the PPT Head and HO before the draft begins (we do this already more or less)

2. Any war room member providing mock draft advice or hints (in any fashion, to anybody, public or private) as to how the draft unfolded after the relative pick has been made behind the scenes is considered a leak and will be punished accordingly

3. Any war room member posting a mock draft article or similar media piece, of any accuracy, after the 1st round has started behind the scenes will be considered a leak and will be punished accordingly

Thanks,

HO

Someone tell me if I should get upset about this.

Good decision.

I am glad to see that the fact that media hadn't been punished before was acknowledged in the eventual decision.

This seems pretty reasonable.

Hey the appeals people did a thing that worked!

Ok well I wrote this a long time ago, but considering Kolbe is still not being sufficiently punished, he can eat a big fat dick.

There are two kinds of people in the world.
Someone that gets punished appropriately and fairly under the rules, and then their are people that will not get punished whether from biased decision makers or some other factor.

I believe Kolbe to be the latter of this in the worst possible way.

Kckolbe leaked the results of the draft, (in which the mock drafts were then amended to be much more in line with what Kolbe wanted). Unfortunately I guess the rulebook doesn't explicitly outlaw certain types of leaks so he got off on a technicality? I'm sure quite a few people would not be thrilled about that if it was happening to someone else. Kolbe included.

I tried to defend the original HO punishment, however since my briefs full of precedent and citations were left on "Read" it had no effect. Because of this Kolbe continued bringing everything back to the "bad" punishment instead of trying to rebut my very intelligent points that he never saw because they were in bovo's inbox. It really was just trash talk on a personal level saying the punishment was unfit for head office.

I now realize why Head office was not a paid position for so long. I couldn't really counter this point because he was saying most of these things in ways that I could not defend myself (behind my back in a private locker room or specifically to other people via discord).

Overall, He's just an abrasive person that once he made his mind up about you, he will just continually belittle you.

He was also the GM of a developmental league team that got a lot of those players on board with the trash talk. I found out about this through animosity from those players as well as a teammate of mine saying "I don't really know why kolbe hates you, but he sure does" after the two spoke privately.

The personal attacks never really stopped. No matter what I did next it was wrong and fuel for his bullshit.

So lets recap. He thought HO's totally reasonable punishment was unfair just because they didn't talk to him?? Buddy HO ignores me constantly, get it together.

Now to refute this. You might be thinking, hey maybe you are just a more annoying member?

At this time, I am the only member working on a really big problem that the league was having.

There were not enough playing paying each other compliments. I worked with Timeconsumer and came up with a very good solution to this problem which allowed players wanting to be nice, to still be viewed as edgy. It also allowed for customization and strategy from GMs as well as a more positive environment. It was really a simple, deep and elegant solution.

I stand by saying the other morning's discord compliments are easily in the top 3 most positive things the head office have ever done for the entire league. I also got this implemented while being incredibly sick for a week with triple pneumonia. Yeah.

I cared about the league and spent a lot of time and energy wanting it to succeed.

Another time I really stepped up was when our simmer went rogue and I stepped up to provide snarky comments in discord. I had never snarked in that particular setting before, and I had to delay some personal plans but to me it was worth it because snark is important to me.

Anyways, back to Kolbe and why he is a huge prick, Another example:

Kolbe made a bet against another player, "that the other player's team wouldn't win a game for a season".
The loser of the bet had to go play for the other person's team. Myself nor most of the head office were in head office when this bet first was made.
Well turns out that a tight end had extra attributes which possibly impacted Kolbe losing this bet. I'd also like to note that this bet started because Kolbe was trash talking this other GM non-stop. The GM didn't have much success from a GMing stand point but that still doesn't give anyone the right to act like that. We are here to have fun and be in a pretend football league.

Anyways, the head office quickly voted that any bet like this was a TERRIBLE idea. The entire idea of a sim league is allowing players to have the freedom to make their own decisions on where they sign or what to do in Free Agency.
Also, the end result of this bet is one team getting both of the players, to stack talent on one team vs. having a league with parity and fair teams. Overall it was absolutely garbage from conception to ending.

We vetoed the bet and specifically stated, that Kolbe could still do whatever he wanted, so if he felt the need to honor the bet, he could hit free agency and demand to go to Las Vegas, however there is no way that head office would enforce a bet so asinine.

Now for the classic Kolbe response. Instead of taking responsibility for creating a toxic environment, an unfair bet, or trash talking this other GM, he just doubles down continuing to trash talk the head office, the decision and specifically me. This again makes no sense considering he still had the personal liberty to do whatever the hell he wanted with this bet after the ruling.

I'll add one last thing.

Later on he specifically violated a rule because he wanted to make an example of how the ruling wasn't harsh enough. Which again was absolutely insane given the information that the head office had.
We were pursuing someone for cheating on so many different levels, and we needed a lot more time to get it right.

So we had concrete information on one of the crimes and then punished him for it. Most other people in the sim league new that he was doing much worse so when he got such a slap on the wrist, people were pissed. I get it, but it wasn't
The problem was he was going to get punished for all of that other stuff, we just needed more time to get all of the details and facts straight.

While this is happening, Kolbe decides to become a martyr, break the rule and say this ruling isn't harsh enough. So then we had to hand out the same punishment to him and spend time doing that instead of finishing looking in to the other rules being broken by the previous person.

He definitely has good qualities as a player, is passionate and can put in work for a sim league... But he has had a very negative impact on me with sim leagues.

Interacting with people like him is the reason I stepped down from HO and I don't take this league serious as I have before all of this happened. Having to deal with personal attacks and resulting stress was definitely not worth it for me compared to any fun I was having in the sim league.

All in all, I hope this can explain the differences between prime time Beaver vs still pretty active Beaver.

and I hope I never have to interact with him long term.

I'm out.

Glad HO wound up accepting most of our recommendations.
