I mean just look at the YoungTB fake retirement thread. People were bitching that HO didn't punish him with the full penalty outlined in the rules. Now people are bitching that HO did punish Er with the full penalty. The rules are there for a reason, everyone has access to them, and it isn't like they are a monster read. Follow them and you won't get punished, simple as that.
The problem here is the consistency with which rules are applied. If previous (more egregious) violations were more lenient in their punishment distribution, is it reasonable to expect a strict constructionist stance for any violation? Consistent to their decisions in the past, I would expect leniency, or should there be no consistency to rules violations and everyone is subject to the whimsy of HO/the appeals team?
