Anecdotes of your own personal experiences aren't evidence. If it can be confirmed that Pens was told the same, then his actions violate that message, even if not the rule. Also, I believe it's possible to give mod powers to certain areas of the board and not others - not entirely sure on that though.
Pens was on the PT team, and within like two day he was already taking it upon himself to edit 24 players topic names? Including bot players which GMs had made? To me, having been told that mod powers were only to be used when it pertains to your job, that definitely falls outside of the realm of "valid reasoning." That's just my opinion though.
Also don't think taking a super strict legalistic approach to the rule book is the best way to go... need to leave some flexibility to be able to deal with unique situations that come up that weren't foreseen (like shadow GMs)
Yes, it's your opinion, and the opposite is mine, but the fact that we're able to have opinions on the rule makes it weird to have it as a rule without defining it. If something comes up that wasn't foreseen, then you create a rule to deal with it in the future, but if at the time it was done no such rule was in place, then you let that go. I don't know what shadow GMs are, but if it wasn't explicitly illegal, I'd say the first instance has to be let go, then a rule created to prevent it going forward. You can't punish someone for doing something that's not illegal, even if it turns out after the fact that it should be.
