I mean if it helps when he asked HO when we had a similar plan a while back we got told no so...

When you appointed Isa as your coGM he retired 2 minutes after he was appointed and created 30 minutes later. This situation is exactly the same except with the difference that Kyle retired what a week before hand however the results are exactly the same. 

I have suggested HO reword rule II.A.3 as it is too ambiguous since it says "given draft class" rather than either stating the next draft class or any draft class.
