Lmaoo I completely get what you're saying even though I'm pretty sure I have it right but if any actual con. Law folks want to correct me by all means. That test was just the easiest way to nail down a more general concept.

In case it wasn't clear, I don't know anything about constitutional law, just know a group of not yet lawyers, and they love showing off about how much more law they know lol

What you had stated of it made sense and it was something I think most of the experienced users had already considered the rule as passing that test.
