If somebody was caught doing something that was clearly malicious to gain a TPE advantage, I think that would be appropriate. But in the case of these, I think that it is possible it is moreso a result of carelessness (and can't be proven otherwise). So while some punishment is still warranted, it doesn't need to be a harsh.
